The AML Accountability Gap: Why Explainability Is the New Standard

Law firms are right to be uneasy about autopilot AML compliance. “The algorithm said so” is never going to be an acceptable answer to a regulator. In the eyes of the SRA, and potentially the FCA in due course, handing total authority to software is not innovation. It is a shortcut to serious regulatory penalties.

That is why a strategic shift is taking place in how law firms evaluate AI-driven AML compliance systems. The conversation is moving away from efficiency alone and towards evidentiary defensibility. It is no longer enough for AI to produce an outcome. Firms must be able to explain exactly how and why that outcome was reached.

At the heart of this shift is explainable AI. For law firms operating in a regulated environment, an AI system is only as valuable as its ability to withstand scrutiny. If a model cannot be interrogated, understood, and challenged by a human, it cannot be relied upon to support legal compliance.

In practice, explainability means a firm must be able to deconstruct the logic behind an AI-driven decision. If a system flags or clears an issue, for example within a digital client and matter risk assessment, the firm should be able to identify the specific factors that drove that conclusion. These may include geographic risk indicators, inconsistencies in source of funds information, or unusual behavioural patterns within a transaction. Crucially, that logic should also align with and reflect the reasoning set out in the firmwide risk assessment. Without a clear and traceable rationale, the decision becomes difficult to defend.

It is equally important to validate the model for bias. AI systems can rely on proxy variables that indirectly produce discriminatory outcomes, even where that was never intended. Law firms must be able to demonstrate that their systems have been tested, monitored, and refined to identify and reduce these risks.

Another essential safeguard is a genuine human-in-the-loop framework. Even where AI is used to assist with analysis, the final judgment must remain with the fee earner or the MLRO. Human oversight preserves the professional judgment that regulators, courts, and insurers still expect from lawyers. AI can direct attention and support decision-making, but it should not become the final decision-maker.

As the regulatory environment evolves towards what might be described as AI-native compliance, the firms that lead will not simply be those that adopt AI the fastest. They will be the firms that can demonstrate how their systems reach decisions, how those decisions are reviewed, and how accountability is maintained throughout the process.

In AML compliance, the real advantage will not come from automation alone. It will come from systems that can show, step by step, how they reached a conclusion and how that conclusion fits within the firm’s AML framework.
